Police retirement money protected from diversion

The Police Retirement Trust is a separate legal entity, with assets kept apart from government and fiscal-agency assets. Its money can improve retirement benefits, fund retirement-account contributions, and cover necessary, reasonable, auditable costs directly tied to Trust administration. Extra contributions, including those under Law 106-2017, must support retirement only. The Trust cannot pay overtime, leave payouts, separation settlements, wages, salary differences, ordinary employee benefits, or employer debts. It also cannot cover police operating costs or government budget shortfalls. Officers keep their legal rights to claim these employer-funded payments; the government remains responsible for paying them through lawful funding. Unauthorized transfers, payments, contracts, and other actions are void from the start, and officials can face remedies for breaching their duties. The Trust can accept contributions, manage property, and borrow only for retirement-related purposes that do not jeopardize its resources.

Retirement payments for Puerto Rico police

Active and retired Puerto Rico police officers qualify as eligible Trust members, even without benefits from the listed pension plans. Annual payments have separate rules: retirees must be alive on April 30, at least 55, and have 30 years of service. They must also have retired by the start of the current fiscal year. The Trust sets aside 80% of its April 30 balance for payments only when that balance reaches $7 million. Payments aim to bring total retirement income near 50% of average compensation, counting Social Security and other listed retirement benefits. The Government Retirement Board determines payments and authorizes them by June 30; unused money stays in the Trust for retirement purposes.

Stronger oversight of police retirement money

The Trust’s seven-member board includes two retired officers, two active officers, two fiscal-agency appointees, and one Police Superintendent appointee. Officers elect their representatives for two-year terms starting when they take their oath, due by January 30 after election. Active candidates need 10 years of service; one fiscal-agency appointee chairs the board, and appointed members serve at their appointing authority’s discretion. By March 31 each year, the Trust must report to the Governor and both legislative chambers on the prior fiscal year. Reports include starting and ending balances, income, investment earnings, retiree payments, retirement-account contributions, detailed administrative costs, and a three-year plan. Reports must certify that spending served allowed purposes and that no prohibited spending occurred; the Government Retirement Board keeps supporting audit records. Within 90 days after the law takes effect, that Board must update Trust rules with the Trust board and fiscal agency. Updated documents must expressly certify that Trust money cannot replace ordinary employer obligations; the law takes effect immediately upon approval.
