Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Retired school workers can work past limits

Rhode Island extends its exception to the 90-day work cap for retired school workers from June 20, 2025, to July 1, 2026, unless lawmakers extend it again. The section is effective June 21, 2024, and covers teachers, administrators, and staff retired under state titles 16, 36, or 45. The local education authority must identify a specialized temporary staffing need, hire a retiree with the needed skills, training, and knowledge, and notify the state retirement board that exceeding 90 days is necessary. Before offering the job, the employer must certify in writing that good-faith efforts that school year failed to find a nonretired worker. That notice goes to the retirement system and bargaining agents for all education unions with employer contracts; the exception overrides conflicting laws and rules.

Returning retirees skip contributions, gain no credit

Beginning June 21, 2024, retirees working under the school staffing exception do not pay pension contributions for that work. They also earn no additional pension service credit. The local education authority must pay employer pension contributions as though it hired a new teacher, administrator, or staff member. These rules end July 1, 2026, unless lawmakers extend the exception.
