Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Extra fees end for qualifying defendants

The law ends an extra assessment for defendants with qualifying offenses under Rhode Island law, Section 11-34.1-1 and following sections. It covers guilty pleas, no-contest pleas, and guilty findings. For felonies, the former charge was $500 or 10% of the fine, whichever was higher. For misdemeanors, it was $350 or 10% of the fine, whichever was higher. This repeal ends the extra assessment, not the underlying fine.

Community release and rules for women

Effective upon passage, the law creates a community corrections program for women in Rhode Island. Women qualify if they await trial in the women's division or have prison sentences of two years or less there. Each woman helps the program director build a plan covering work, education, housing, restitution, community service, and needed support. The corrections director or designee must approve the plan, followed by the sentencing judge. After court approval, the woman is released into the program under corrections supervision. A woman found to violate program rules must serve her remaining sentence in a placement chosen by the corrections director. The law removes prior program cost assessments. Private agencies can run the program under contract, with the same civil liability limits as state agencies and employees.
