Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Older liquor licenses stay protected

If your Class B or C license was issued before January 1, 1978, the distance and objection rules do not apply. A transfer also cannot be blocked when the licensed location existed before the nearby school or place of worship.

Liquor licenses blocked near schools, churches

The law blocks new Retailer Class B, C, N, and I licenses within 200 feet of any school or place of worship. A license is also blocked if the owner of most land within 200 feet files an objection. In East Providence, Class A licenses are barred within 500 feet of a school or place of worship. A private school means a nonpublic K–12 school recognized by the state education department or the local school committee.

Local license exemptions for listed properties

Local boards of licenses can approve exemptions for specific parcels, districts, or addresses named in state law. In Cranston, an exemption is not effective unless the proposed Class B license holder and the property owner are current on all local and state taxes. In Smithfield (Plat 45, Lot 042), the exemption covers only renewals of licenses in use on December 31, 2011, and it ends if not renewed. In North Providence, the board can allow a Class BV license at 1706 Mineral Spring Avenue (Plat 19, Lot 326) after application.
