Homeowners must share private access upkeep costs

Without a written agreement, homeowners who use a private access road must keep it in good repair, including snow removal. All benefited owners share costs, set by each home's municipal appraisal. If you or your guests cause damage, you alone must fix that part, whether you own the benefited or burdened property. Any demand for payment must include contractor proposals, evaluations, applications, costs, and how each share was calculated. Existing written agreements control, and owners can sue in Superior Court if someone refuses to repair or pay after a proper demand.
