Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Faster claim payments with 12% interest

Health plans must pay complete electronic claims in 30 days and paper claims in 40 days. If they pay late, they owe 12% yearly interest from day 31 or day 41 until paid. These rules apply to claims from providers and policyholders. The law is in effect now.

No third-party denials and doctors must bill

Health plans cannot deny payment just because a bill may involve a third party. This does not apply to workers’ compensation claims. Doctors must submit bills to insurers and cannot hold them back for that reason. This also does not apply to workers’ compensation claims.

Clear rules for claims and notices

Each health plan must define a “complete claim” in writing and share it. If a claim is denied or pended, the plan must send a written notice with all reasons within 30 days. You can resubmit, and the prompt‑pay clock restarts. Plans cannot set a deadline to send missing info. Any contract term that tries to override these rights is void.

Exceptions and waivers to payment rules

Some limits apply to timing and interest, such as court or agency orders, liquidation or rehabilitation, late filings over 90 days, or fraud investigations. The director can find a plan in “substantial compliance” if it pays 95% of claims on time, which can remove interest. The director may also grant a waiver up to 90 days during major system changes.
