Long-Term Care Council membership and rules
The law sets who serves on the Long-Term Care Council. Members include the Governor; the heads of Social Services, Public Health, Behavioral Health (Mental Health and Intellectual and Developmental Disabilities), Aging, and Health and Human Services; the Secretary of Veterans’ Affairs; and the chair of the Joint Legislative Committee on Aging. The Governor also appoints three private members: one provider, one consumer, and one from the insurance industry selling long-term care. Each director may let a designee vote at up to two meetings a year. Private members serve without pay. The council meets at least quarterly, elects its officers, and sends an annual report with new recommendations to the General Assembly by January 2 each year.
Plan to improve long-term care access
The law requires member agencies to share needed data with the council. The council studies long-term care policy and can run research and demonstration projects. It develops recommendations for a statewide service system for all health‑impaired elderly or disabled people, no matter their resources or how they pay. The plan covers charges based on ability to pay for people not on Medicaid, coordination of community services, access to the right mix of services, case management, and discharge planning. The council also studies adult day care, in‑home and institutional respite, adult foster homes, family incentives such as cash help, tax credits, or deductions, and home‑delivered services. It works to keep a statewide access system for long‑term supports and services. The council updates its recommendations each year as needed.
Council cannot force state agencies
The law limits the council’s power. It can recommend and coordinate plans, but it cannot direct or require any member agency to take action. Agencies do not have to adopt council recommendations.
