Drivers face tougher penalties for fleeing police

Beginning May 12, 2026, drivers must stop for police lights or sirens. Speeding up or trying to avoid them is evidence you fled. Saying you did not see or hear the signal is not a defense if a reasonable driver would have. Penalties: a first offense is a misdemeanor with at least a $500 fine, up to 3 years in jail, and at least a 30‑day license suspension. A second or later offense is a felony with up to 10 years in prison and a 1‑year suspension. Leading a high‑speed pursuit—by speeding up or taking evasive moves—is also a felony with up to 10 years and a 1‑year suspension. If your unlawful driving causes great bodily injury, the felony carries up to 15 years; if it causes a death, up to 30 years.
