AN ACT TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 11-35-5350 SO AS TO REQUIRE A PUBLIC ENTITY ENTERING INTO A CONTRACT FOR A PUBLIC WORKS PROJECT OR FOR THE PURCHASE OF MATERIALS FOR A PUBLIC WORKS PROJECT MUST INCLUDE IN THE CONTRACT A REQUIREMENT THAT ANY IRON OR STEEL PRODUCT PERMANENTLY INCORPORATED IN THE PROJECT BE PRODUCED IN THE UNITED STATES, AND TO PROVIDE EXCEPTIONS.

Exceptions to U.S.-steel rule for projects
The head of the purchasing agency can waive the U.S.-steel rule if U.S. materials are not available or suitable, if using them raises total project cost by more than 25%, or if it is against the public interest. Small amounts of foreign steel are allowed when incidental and not listed separately, up to 0.1% of total project steel and iron costs or $2,500 (whichever is greater). A domestic product may also include up to 5% foreign steel or iron by materials cost. Electrical components and equipment needed for an electrical system are exempt, but transmission and distribution poles are not. Emergency repairs for health, safety, or property are excluded from the rule. Department of Transportation contracts under federal Buy America rules are excluded. Projects financed with South Carolina Housing Finance and Development Authority bonds or backed by state tax credits are not treated as using state funds for this rule.
U.S.-made steel required in state projects
Beginning June 30, 2026, state and local agencies must write into public works contracts that iron and steel built into the project are produced in the United States. Produced in the United States means every step from initial melting through coatings happens in the U.S., except refining steel additives. The rule applies when projects use state-appropriated funds or state funds run by a public entity. The State Fiscal Accountability Authority issues rules to carry this out and align it with federal policy.
