No state water permits for roadside markets
Beginning May 15, 2026, a qualifying roadside market is exempt from the state Surface Water Withdrawal, Permitting, Use, and Reporting Act. You do not need those state permits or reports for the market.
Zoning and permit relief for roadside markets
Beginning May 15, 2026, qualifying roadside markets are not treated as commercial operations for zoning. Counties and cities cannot force commercial rezoning. These markets are exempt from local stormwater permits and rules. They are also exempt from local building permits, inspections, and commercial construction rules. Local governments are not liable for harms that result from these exemptions.
Rules and limits for farm roadside markets
Beginning May 15, 2026, the law defines a roadside market. It must be near a road, on land you own or lease in South Carolina, and under your control. You may sell only products grown or produced on your own South Carolina farm. Multivendor farmers’ markets do not qualify. You may not sell hemp products meant to be eaten or swallowed at a roadside market.
Roadside market certification rules still apply
Beginning May 15, 2026, if you seek certification under the Department of Agriculture’s Roadside Market Incentive Program, you must meet that program’s rules. The roadside market exemptions do not waive any requirements of this voluntary certification.
