4 provisions identified: 1 benefits, 0 costs, 3 mixed.
Beginning May 8, 2025, a person or company that resells power at an EV charging station is not an electrical utility when three rules are met. The reseller buys electricity from an authorized retail seller. It sells electricity only to charge plug‑in EVs. The charging station is fixed in place, not mobile.
Beginning May 8, 2025, utilities and public power that run public DC fast chargers must offer fair, reasonable, and nondiscriminatory rates and service to all providers. They cannot give an unreasonable advantage to their own stations. Money from other electric services cannot directly or indirectly subsidize DC fast‑charger investments they own or run. These rules do not apply to stations the entity had in place before May 8, 2025, or to nonpublic fleet chargers on their premises that only serve the entity’s or employees’ vehicles.
Beginning May 8, 2025, the law adds clear EV terms. A direct‑current fast charger must deliver at least 50 kilowatts of direct current at 200 volts or more and is separate from make‑ready gear. An electric vehicle is a motor vehicle powered by electric motors using a rechargeable battery. An electric vehicle charging provider is the owner of a charging station.
Beginning May 8, 2025, utilities and public power may build the make‑ready grid work needed to serve EV chargers and charge for that work. They may also use state or federal grant money for these hookups. Increases in demand from transportation electrification do not count as found revenues for utilities.
