AN ACT TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDING SECTION 2-3-20, RELATING TO COMPENSATION OF MEMBERS OF THE GENERAL ASSEMBLY, SO AS TO PROVIDE THAT MEMBERS OF THE GENERAL ASSEMBLY SHALL RECEIVE LEGISLATIVE COMPENSATION AND AN IN-DISTRICT LEGISLATIVE SERVICE ALLOWANCE OF A COMBINED FORTY-SEVEN THOUSAND FIVE HUNDRED DOLLARS, AND TO PROVIDE THAT SUCH AMOUNT SHALL BE ADJUSTED EVERY TWO YEARS BY AN INFLATION FACTOR NOT TO EXCEED FIVE PERCENT.

Higher pay and allowance for state lawmakers
Beginning with the 128th General Assembly, each member gets $15,000 in pay and a $32,500 in-district allowance. That totals $47,500 a year. Members also get mileage for weekend trips between home and the session location at the legal rate. The Senate President, House Speaker, and House Speaker Pro Tempore can receive extra pay set each year in the state budget.
Automatic inflation raises for lawmakers
Every two years after House elections, lawmaker pay and the in-district allowance increase with inflation. The increase uses the chained consumer price index for the prior two years and is capped at 5%. The Revenue and Fiscal Affairs Authority calculates the change, posts it online, and sends it before the second Tuesday in January.
128th members must accept higher pay
For the 128th General Assembly, a member must file a written acceptance with the Clerk to get the higher pay, including any inflation adjustment. If a member does not file, the member keeps the same pay that the 126th General Assembly received. Filing cannot depend on how the member voted on the increase.
