Drug offenders lose licenses, get limited driving

For listed drug offenses committed in a vehicle, a first conviction or juvenile delinquency finding brings a 90-day license revocation. Repeat offenses bring revocation for one year or until the person's 17th birthday, whichever is longer. A court may allow limited driving after receiving proof of financial responsibility under § 32-35-43.1. Allowed trips include work, child care pickup or drop-off, health visits, school, court, probation appointments, 24/7 sobriety testing, counseling, treatment, or aftercare. The court system must notify the Department of Public Safety of qualifying convictions and juvenile findings. Revocation starts on the earlier of the court-ordered date or the date in the department's notice. After revocation ends, the person may apply for reinstatement and must pay the required license fee.

Suspended drivers get limited essential trips

For driving privileges suspended under § 32-35-121, judges must limit driving to the law's listed needs. Allowed trips include work, child care pickup or drop-off, health visits, school, court, probation appointments, 24/7 sobriety testing, counseling, treatment, or aftercare. Before driving, the person must establish one form of financial responsibility allowed under § 32-35-113. They must maintain it throughout the restriction, which lasts for the full required suspension period.
