New court fee with eviction exemptions

South Dakota adds a $25 surcharge for an answer or first response in covered circuit court proceedings. Courts collect it like other court fees, but eviction cases and proceedings covered by § 16-2-58.1 are exempt. Responding parties receiving assistance under Title 28 also pay no surcharge. The state, counties, municipalities, and school districts are exempt when responding to a case. Existing fee-waiver rules under §§ 16-2-29.2 and 16-2-29.3 remain available.
