Farm meat sales await federal legalization

The law creates a direct-sales option for South Dakota livestock producers, but it does not activate that option immediately. Sales begin only when the Attorney General certifies federal legalization to code counsel. This requires a federal law allowing these sales or a final ruling by a federal court with jurisdiction over South Dakota. The ruling must declare the federal sales ban unconstitutional or otherwise invalid. Producers must raise the cattle, sheep, pigs, or goats for at least 90 days. Animals must be slaughtered at a custom exempt plant in South Dakota, and the meat must be processed in-state. Producers must sell directly to end consumers in South Dakota, and federal law must not prohibit the sale. Allowed locations are the producer’s primary home, a farmers’ market, a roadside stand, or another temporary sales venue. Packaging must carry a label at sale stating that the meat is uninspected and unregulated. The label must also state that buyers agree not to resell, donate, or commercially redistribute it.
