Free public access to voter records

South Dakota county voter files are open for free public inspection, with privacy protections. Files include voter registration card details, the last election voted in, and the last update date. Absentee application details include mailing addresses, ballots requested, request and return dates, and voting methods. County auditors must provide a file record by 11:59 p.m. the day before each primary or general election. Counties keep rolling five-year archives. The secretary of state also keeps a free, five-year statewide archive, updated weekly. Social Security numbers, driver license numbers, South Dakota nondriver ID numbers, and birth month and day stay private. Purged or unregistered voters are excluded from active files; their registration forms are kept for 22 months.

Voter record privacy for judges and police

County and statewide voter files shield personal contact details for current or retired state and federal judges and justices. Law enforcement officers covered by state law receive the same protection. Home addresses, home or personal phone numbers, and personal email addresses are not open to public inspection. City and county of residence remain public. State judicial officials coordinate with federal courts to identify protected judges; the state criminal investigation director supplies officer lists. The law does not create a private right to sue over violations of this protection.
