Courts can ease public-purpose land restrictions

South Dakota courts can change restrictions on land given for charitable, educational, religious, or other public purposes. After a hearing, the court must find that changed conditions make the original holding or use impossible or impractical. Courts can change how the land is managed or used, including allowing it to secure a loan. These changes must serve the original public purpose as closely as possible under current conditions. Courts can also allow the land's recipient to sell it for the highest price obtainable. Sale proceeds must be reinvested in a way consistent with the original public purpose.
