More privacy in protection order cases

In South Dakota, clerks must immediately seal protection-order petitions and supporting papers when courts dismiss them without a hearing. After a hearing, courts must seal denied cases if they find the petition had no basis in fact or law. That finding must be on the record and also show the petition was harassing, frivolous, or abusive. For these sealed denied cases, courts must notify law enforcement, which must make its petition records nonpublic. The Unified Judicial System must also apply the dismissal-without-a-hearing rules retroactively to all electronically maintained court records.
