Broader tribal background checks with fees

At a tribe’s request, South Dakota’s Division of Criminal Investigation can obtain national criminal records for applicants and current role holders. Covered roles include tribal or district council members, tribal judges, board or commission members, conservation officers, and tribal business executives. Tribal education faculty and administrators, child-protection and youth-program workers, and people working with tribal juvenile offenders are also covered. Checks also cover tribal gaming licensees, foster parents, and prospective adoptive parents. For child-protection and youth-program roles, checks cover only information unavailable through the Bureau of Indian Affairs under federal child-protection law. For gaming licensees, checks apply when screening is unavailable through the National Indian Gaming Commission. The requesting tribe must submit completed fingerprint cards to determine whether a person is suitable for a covered role. The tribe must pay all state and FBI processing fees, or require the applicant or current role holder to pay.
