authorize the use of bingo games, lotteries, and pull-tab devices by booster clubs.

Booster clubs gain fundraising games with limits

South Dakota booster clubs can hold bingo games and lotteries without those activities being treated as gambling. Other eligible groups include religious, charitable, educational, and fraternal organizations; civic and service clubs; congressionally chartered veterans’ organizations; volunteer fire departments; qualifying local industrial development corporations; political parties; and political committees acting for state-office candidates. Proceeds cannot directly benefit an individual. Bingo prizes cannot exceed $2,000 per play. Lottery prize values must be stated before chances are sold. Ticket sellers can receive a stated-value prize for selling a winning ticket selected at random. Organizers must give at least 30 days’ written notice to the relevant local government, which must not object. Statewide lotteries also require notice to the secretary of state and the local government where the drawing occurs. Municipalities can ban lottery ticket sales within their borders. Organizers generally cannot hire outside groups or professionals to run games, except under the pull-tab device rules. Service pay is capped at the greater of the state minimum wage or $60 per hour. That cap does not apply to county fairs, the state fair, or locally recognized civic celebrations. Equipment and service agreements are generally barred, except for authorized pull-tab devices and distributor agreements for equipment and supplies. Booster, civic, service, charitable, and fraternal groups, volunteer fire departments, and qualifying congressionally chartered veterans’ organizations can obtain coin- or bill-operated pull-tab devices. Each purchaser can place one device in each of no more than two establishments it does not own or operate. Those establishments must hold licenses under § 35-4-2(4), (6), (12), or (16). Each establishment can have only one device. Purchasers must keep all device proceeds, and existing pull-tab and bingo licensing rules still apply.
