South Dakota carriers face updated safety rules

South Dakota adopts selected federal trucking and hazardous-material rules updated through January 1, 2026, with state changes. These cover parts 107 (subparts F and G), 171–180, 387, and 390–397. References to interstate operations also cover trips within South Dakota. In-state drivers and carriers are exempt from parts 390–397 when vehicle or combined weight ratings are below 26,001 pounds, but only when vehicles carry no hazardous materials requiring warning placards and are not designed for more than 15 passengers, including the driver. Drivers must be at least 21 for interstate commerce, placarded hazardous-material transport, or vehicles designed for more than 15 passengers, including the driver. Other drivers must be at least 18. Specified driver, insurance, safety, maintenance, hazardous-material registration, communication, and marking violations are Class 2 misdemeanors. Specified hazardous-material packaging, shipment, loading, separation, cargo-tank testing, and carriage violations, plus hazardous-material driving and parking violations, are Class 1 misdemeanors.
