Child care zones restrict sex offender housing

South Dakota adds licensed day care centers, licensed group family day care homes, and registered family day care to community safety zones. These zones cover each site's facilities and grounds and extend 500 feet beyond them. People required to register as sex offenders cannot establish a home or live within these zones unless an exemption applies. A violation is a Class 6 felony; later violations are Class 5 felonies. Exemptions cover correctional placements, assigned halfway houses or supervised living centers during parole or probation, and homeless people admitted to community homeless shelters. They also cover placement in licensed health facilities or facilities certified under Medicare or Medicaid, and services from state-accredited or state-certified community service providers. Other exemptions cover offenses committed before age 18 without an adult trial and conviction, residences established as of July 1, 2024, sites established after the person's residence, and qualifying circuit court exemption orders.
