Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Emergency workers get driving record protections

The law keeps qualifying emergency-duty crashes off workers' personal driving records. This covers law enforcement officers, firefighters, and emergency medical technicians lawfully performing official duties while driving emergency vehicles. Snow-removal operators also qualify when responding to an emergency call while lawfully driving official snow-removal equipment. Their work must support an emergency call of duty by law enforcement officers, firefighters, or emergency medical technicians. The department records these crashes separately.

Drivers pay $7 for certified records

The department must provide a certified driving record on request for people covered by chapter 32-35. Each record costs $7, except requests from government entities or their subdivisions are free. Records cover the last three years, but that limit does not apply when you request your own record. Records list reported crashes and convictions. Fees go to the State Motor Vehicle Fund.

Higher fees to restore suspended licenses

Drivers suspended under South Dakota's chapter 32-35 must pay a higher fee before their license or driving privilege is restored. Payment goes to the South Dakota Department of Public Safety. The fee is set by SDCL 32-12-47.1(1)(f); this text does not state the amount.
