South Dakota voter files updated weekly
South Dakota’s Secretary of State must maintain a computerized statewide voter registration system. County auditors must send registration changes and absentee voter log changes daily through that system. They must also send updated county registration information by July 15 after each primary and December 15 after each general election. The Secretary must post the complete statewide file, including county registration updates, online before 11:59 p.m. Central Time each Monday.
Free voter history with data-use limits
South Dakota’s Secretary of State must keep a free, rolling five-year archive of complete statewide voter files, including weekly postings. The online archive must be updated before 11:59 p.m. Central Time each Monday. Archived Social Security numbers, driver’s license numbers, South Dakota nondriver ID numbers, and birth month and day are closed to public inspection. Statewide and county voter data cannot be sold, used commercially, or posted for unrestricted internet access, except as the publication and archive laws allow. Campaigns and political polling do not count as commercial uses. The Secretary can still charge for paper voter lists as allowed by law. Violations are Class 1 misdemeanors and can also bring civil penalties of up to $2,000 per violation. Civil penalties collected go into the state’s general fund.
