Higher penalties for supplying drugs to inmates

South Dakota law makes supplying unauthorized drugs to inmates a Class 3 felony. This covers prescription drugs, nonprescription drugs, and controlled substances not authorized by the Department of Corrections. It applies to anyone who delivers drugs, arranges delivery, or possesses them with intent to deliver. It also covers hiding or leaving drugs around inmate facilities or in vehicles entering facility grounds or related areas. In each case, the person must intend for an inmate to get the drugs.
