New safety design guidance for Tennessee schools
Effective upon becoming law, the act creates a six-member Safe School Design Advisory Board within Tennessee's Department of Commerce and Insurance. It develops guidelines for school districts and public charter schools to consider when building or remodeling kindergarten through 12th-grade facilities. The guidelines cover security, fire safety, emergencies and evacuation, access and visibility, first-responder coordination, student well-being, and durable, flexible buildings. The board must review building and fire codes, national best practices, and schools' operating needs. The commissioner must call its first meeting by July 1, 2026; recommendations are due to the commissioner by January 1, 2027. After that date, the board must meet at least yearly and recommend updates for new threats, technology, practices, and codes.
Public access to school safety planning limited
The school design board's meetings are closed to the public and exempt from Tennessee's open meetings laws. The board must still give reasonable public notice before each meeting. Its recommended guidelines are also excluded from public access under public-records laws. They may be shared only with government entities.
School safety board members serve without pay
The board's six members receive no pay or travel reimbursement for their service. Members represent education, safety, the state fire marshal, and the state architect, alongside a licensed school-design architect and a school-facilities expert. The architect must belong to the American Institute of Architects in Tennessee and have experience designing kindergarten through 12th-grade facilities. The education commissioner appoints the education representative and facilities expert; the commerce and insurance commissioner appoints the licensed architect. The safety commissioner, fire marshal, and state architect each appoint their own representative. Members serve until their seats become vacant or their appointing authority replaces them.
