New cost protections for utility customers

Beginning July 1, 2026, these protections apply to conduct on or after that date involving covered Tennessee utility construction. Combined fees under Section 7-51-2704(a)(1) and (f) cannot exceed 10% of the proposed project cost. Inspection and testing fees must also be reasonable and listed in a fee schedule the utility adopts and makes public. When required construction materials are available only from the utility, it must sell them to customers or approved contractors at its purchase price. Taxes charged cannot exceed what the utility paid, and it must provide an itemized material-cost statement. Customers and approved contractors can choose to install streetlights, but utilities cannot require them to do so.
