Small businesses gain rights to search explanations
Beginning July 1, 2026, Tennessee law covers conduct occurring on or after that date. Businesses qualify with 50 or fewer full-time employees, counting their affiliates. They can request a written or electronic response when they believe a search engine has reduced their website’s visibility or accessibility. This also covers removing their website or a search result, or deleting at least 25% of their reviews. Covered engines primarily search the internet; social media, review websites, and other platforms are excluded. The engine must respond within five business days after receiving the request. It must explain and justify its action, or provide appeal, restoration, or re-indexing steps and a representative’s contact information. Businesses can sue for violations of these response rules. Courts may award actual and punitive damages, reasonable court costs, and attorneys’ fees, and order ongoing response-rule violations to stop.
