3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Pain clinics gain clearer compliance guidance

The Department of Health must post all required pain clinic inspection criteria on its website. Affected licensees can request a private advisory ruling from the commissioner or the commissioner's designee on matters covered by these rules. Officials can issue a ruling, but it applies only to the requester and sets no precedent for later cases. The commissioner or designee can choose to resolve a dispute through the process in Tennessee Code Section 4-5-223.

Pain clinics gain temporary director flexibility

A pain management specialist can provide short-term coverage when a clinic's medical director is unavailable because of illness, vacation, or another reason. The substitute need not be on-site but must be immediately available by phone when away. This service does not count toward the four-clinic limit, and the department cannot require the absent director to report the substitute's identity. A related clinic rule changes from weekly to quarterly; the supplied text does not identify the activity. The law took effect upon becoming law.

Prescribers face reviews and removal options

Beginning July 1, 2017, Tennessee must identify high-risk prescribers each year using clinical outcomes, including patient overdoses. The Department of Health must publish its criteria and conduct selected chart reviews and investigations of identified prescribers. A related timing rule changes from four weeks to 30 days; the supplied text does not explain the activity. To remove the label, prescribers must prove course completion and meet one of two conditions: no overdose behind the label involved a substance they prescribed, or the state does not identify them as high-risk for the next two consecutive years. The department must remove the label and notify qualifying prescribers in writing.
