Acute care hospitals in areas covered by certificates that expire under this law no longer need a certificate of need. This removes that state approval requirement for qualifying hospitals. It does not guarantee a new hospital, lower bills, or better access to care.
The law takes effect immediately. Tennessee hospital certificates of public advantage still active on June 30, 2028, expire that day. Their price limits continue in the covered service area until June 30, 2033, unless a new inpatient acute care hospital opens there sooner. After June 30, 2028, Tennessee's attorney general and reporter supervises those limits under an agreement. Changes require written agreement between that office and the affected entity, which pays the supervision costs. The attorney general keeps the power to enforce state and federal antitrust laws.
