New certification and director rules for fertility clinics
Beginning January 1, 2027, every fertility clinic must have a Tennessee Department of Health certificate to offer assisted reproductive technology. To renew every two years, clinics show membership in the Society for Assisted Reproductive Technology or a department-approved equivalent, file an emergency plan to transfer embryos if the clinic closes, and show a recent lab pass from the College of American Pathologists or the Joint Commission. The clinical director must be a Tennessee-licensed physician, board certified in obstetrics and gynecology, with an accredited fellowship in reproductive endocrinology and infertility or equal training, substantial ART experience, and ongoing continuing education. These rules add oversight and help protect patients and stored embryos.
State definitions and health department rules for fertility care
The Tennessee Department of Health can write rules to carry out this law now. Official definitions take effect January 1, 2027. The law defines assisted reproductive technology using federal law, and explains what counts as a fertility clinic, including embryo labs and storage sites.
Genetic testing rules without new lawsuits
Beginning January 1, 2027, fertility clinics must follow current genetic testing guidelines from national reproductive medicine or obstetrics groups. The law does not force one specific guideline. It does not create a private right to sue or set a new legal standard of care.
