Beginning July 1, 2026, trespass that uses a motorized vehicle or bicycle is a Class A misdemeanor. The court must impose a $2,500 fine. The sentence also includes restitution for all property damage. On a second or later conviction for trespass using a vehicle or bicycle, law enforcement can seize and keep the vehicle used. Vehicles covered include ATVs, utility task vehicles, side-by-sides, electric bicycles, motorcycles, and motorscooters.
Beginning July 1, 2026, Tennessee broadens what “enter” means for criminal trespass. Intrusion of the entire body counts as entering. Causing a drone to fly into airspace over someone’s land that is not FAA navigable airspace also counts. So does driving, parking, or operating a motorized vehicle or bicycle, such as ATVs, side-by-sides, e-bikes, motorcycles, and motorscooters. These updates give property owners clearer protection against trespass.
