Texas school districts and open-enrollment charter schools must give parents at least 90 days’ written notice before disposing of confiscated devices. The notice must state the school’s intent to dispose of the device, and disposal must be reasonable. The law also removes the former authority to charge owners or parents up to $15 to release a confiscated device.
Texas school districts and open-enrollment charter schools must adopt and enforce written policies banning students’ personal device use on school property during the school day. Covered devices include phones, tablets, smartwatches, radios, pagers, and similar communication devices. Schools may ban bringing devices, require storage, or use discipline and confiscation. Policies must allow use needed for an individualized education program, Section 504 plan, or similar plan. They must also allow documented needs directed by a qualified doctor and use required by law or school safety protocols. School-provided devices and adult education programs under the specified adult-education charter rules are excluded. The law took effect upon enactment, and schools had 90 days afterward to adopt policies. The Texas Education Agency must publish model policy language online.
