Beginning September 1, 2025, Texas hospitals must accept full payment directly from patients who request this option. You qualify only if you are not enrolled in or otherwise entitled to coverage under a health benefit plan. Ask within 60 days after receiving your bill or final accounting, which must explain this option. The hospital's charge cannot exceed either of two limits: 25% above the federally defined amounts generally billed, or 50% above its lowest qualifying contracted rate. Medicaid, CHIP, and Medicare rates are excluded from the contracted-rate comparison. The law covers licensed public and private hospitals, but not separately licensed outpatient surgery centers. You keep any right to charity care you otherwise have.
