Brazoria County commissioners can designate reinvestment zones within the Port Freeport district, including district-owned property. They must find that the property meets the Tax Code's Section 312.202 criteria, as though a municipality were creating the zone. Within these zones, commissioners can approve property-tax breaks for owners of leasehold interests in tax-exempt or district-owned real estate. They can also approve breaks for owners of tangible personal property, such as equipment, or improvements on that land. Agreements can exempt all or part of the covered value; no tax break is guaranteed or fixed in amount. Other agreement terms follow Chapter 312 of the Tax Code. The law took effect immediately with a two-thirds vote of all elected members in each house; otherwise, September 1, 2025.
