More families can skip adoption evaluations

Beginning May 7, 2025, Utah expands exceptions to the full evaluation normally required before an adoptive placement. Former spouses qualify when the child’s existing parent has or had legal custody. The adopting former spouse must have lived with the child for at least 180 days before filing the adoption petition. Another exception covers children who lived with the prospective adoptive parent for at least one year before filing. For that exception, the court must find the adoption is in the child’s best interests. The existing family exception remains when a current parent has legal custody. It covers prospective parents related to that parent or child as a stepparent, sibling by birth or adoption, grandparent, aunt, uncle, or first cousin. Families using an exception still must obtain required criminal-history and child-abuse records and file them before adoption finalization. The court can still request a full evaluation for any exception.
