Analyzed Economic Effects

4 provisions identified: 0 benefits, 4 costs, 0 mixed.

Federal release notices for undocumented inmates

Utah sheriffs must notify federal authorities before releasing people unlawfully present after felony or covered class A misdemeanor jail sentences. Covered misdemeanors are offenses against individuals, except bodily-substance offenses, hazing, secret administration of certain substances, and custodial interference. Jail notices must come as soon as practicable before release. Utah corrections must give notice as soon as practicable and at least five business days before release after felony imprisonment. Both agencies must coordinate custody transfers to federal authorities when required.

Immigration status shapes release before trial

Courts presume flight risk for foreign nationals verified through the jail process as not lawfully admitted to the United States. In felony bail decisions about flight risk, courts also apply that presumption to people not lawfully present. People can present evidence to challenge either presumption. Court information submitted after a warrantless arrest and jail booking must include immigration status for noncitizens who are not U.S. nationals. Beginning May 7, 2025, sheriffs may include immigration status in written policies for release on a promise to return.

Longer sentence limits for some misdemeanors

The maximum sentence for covered class A misdemeanors against individuals rises from 364 days to one year. The 364-day limit stays for propelling bodily substances, hazing, secret administration of certain substances, and custodial interference. A covered misdemeanor term beginning while someone serves a felony in state prison also loses its one-day credit. That misdemeanor prison term has no fixed length but cannot exceed one year.

Some noncitizen inmates lose transition help

Utah corrections excludes some inmates from specified transition and state identification assistance procedures. The exclusion applies to inmates who are neither U.S. citizens nor lawful U.S. residents with legal permission to work.
