Fee protections for veterans seeking benefits

Beginning May 7, 2025, paid VA claim helpers must put fee terms in writing before doing any work. Both parties must sign, and the agreement must follow federal fee rules. Helpers cannot collect referral payments or charge for work done before a notice of disagreement, decision review, or appeal is filed—whichever comes first. They cannot guarantee a specific benefit result or charge excessive or unreasonable fees. Required disclosures explain that initial application help is free and that income from resulting product or service sales must be justified and reasonable compared with similar Utah offerings.

More safeguards for veterans seeking claim help

Beginning May 7, 2025, Utah requires VA claim helpers to be federally accredited or work under accredited-attorney supervision. Covered help includes advice about a person's claim and preparing or submitting an application. Before helping, providers must give a state-approved disclosure listing their identity, contact details, VA registration number, governing rules, and veterans' rights. Both sides must sign it, and its terms cannot be crossed out. Veterans get a copy that day; providers keep it three years and submit it within five working days. Helpers must complete three hours of qualifying education within 12 months after initial accreditation, then three hours every two years. Accredited representatives acting for Utah's veterans department are exempt from the act's requirements; certain recognized veterans organizations also have exemptions. The veterans department must notify veterans about disclosures, and state agencies can audit compliance. Utah's Division of Consumer Protection can take complaints and pursue enforcement; breaking the assistance rules counts as a deceptive business practice.
