Online rental listings gain local protections

Beginning May 7, 2025, Utah protects online listings for residential rentals offered for fewer than 30 consecutive days. Cities and counties cannot ban these listings or punish someone solely for posting one. The penalty protection has an exception for internal accessory dwelling units when the local government has the required filed or recorded notice. Cities and counties also cannot regulate short-term-rental websites. Covered websites include digital platforms that let people offer rentals and help arrange both rentals and payments.

Rental listings can support tax reviews

Beginning May 7, 2025, Utah officials can use rental listings to review possible room-tax obligations. This applies where a transient room tax is imposed on qualifying stays of fewer than 30 consecutive days. Cities can send listings to county auditors, and counties can also use listings as tax evidence. County auditors can use listings when referring matters to the Utah State Tax Commission. This changes tax enforcement, not tax rates; a listing alone does not establish that tax is owed.

Rental hosts face enforcement with safeguards

Beginning May 7, 2025, Utah cities and counties can adopt rules requiring rental owners or lessees to get licenses or permits before operating. City rules apply within city limits; county rules apply in unincorporated areas, and this law sets no fee. Local governments that regulate short-term rentals can use listings as evidence of a rental, but need other information supporting an ordinance violation. Where they allow short-term rentals in some residential or commercial zones, they can request removal of listings for rentals violating license or zoning rules. They must first give notice identifying the listing’s web address and the reason; a request does not require removal.
