8 provisions identified: 3 benefits, 3 costs, 2 mixed.
By April 1, 2030, secondary-water suppliers must provide customers with water-use education. It must appear on monthly statements or a customer-specific online portal showing usage more often than monthly. Utah's Division of Water Resources sets the education requirements by rule. The law guarantees no bill savings.
Beginning July 1, 2030, secondary-water suppliers using tiered conservation rates must charge food-growing customers the lowest tier rate. Customers qualify if they use any portion of their water to grow food. This includes gardens, fruit trees, and pasture for grazing. The law sets no rate amount or dollar savings.
Public water systems may use conservation-rate revenue for conservation work shared with another public system or wholesale water supplier. For-profit systems cannot use conservation revenue from their highest-use block to pay profits or dividends to owners or investors. The law sets no funding amount or customer discount.
Utah municipalities may use conservation to justify different customer rates, and water districts may include conservation costs in service charges. Retail drinking-water suppliers must consider conservation when setting rates. By July 1, 2027, primarily residential increasing-block plans must include conservation efforts in at least the highest-use block's rate. Suppliers must also consider urban farming that improves food security, reduces pollution, and creates green spaces. The conservation portion of the highest-use rate is legally treated as reasonable without the specified actual-cost, comparison, or reasonable-return tests.
Secondary water is water used for irrigation. Contracts made or renewed on or after July 1, 2025, must allow tiered conservation billing. By July 1, 2030, suppliers must use tiers that consider stable revenue, conservation, and service costs. Suppliers with statutory metering exemptions or approval to meter at strategic system points are exempt from this billing requirement. Suppliers may hire a third party to bill based on each customer's use; the law sets no tier prices.
For covered secondary-water billing violations on or after April 1, 2030, suppliers lose access to state water-related money until compliance. The Division of Water Resources director can refer violations to the state engineer when enforcement is needed to protect or conserve state water. Administrative fines cannot exceed the supplier's metering-cost funds received under the specified state funding programs. These penalties apply to suppliers, not directly to household customers.
Public water systems must provide billing services when a secondary-water supplier requests them and supplies needed data in a compatible format. Systems must exchange relevant customer information to keep records accurate. They may collect reasonable billing, administrative, and overhead costs from those customers. Public water systems may also put fees, surcharges, penalties, and other charges collected under their wholesale water agreements on customer bills. The law sets no charge amounts.
The law removes the rule limiting Utah's Board of Water Resources to five members from the same political party. It does not directly change household water rates or service eligibility.
