The law expands which traffic cases count as traffic offenses under Utah’s record-sealing rules. It includes specified infractions and class C misdemeanors involving motor vehicles and vehicle financial responsibility. Driving without required insurance or other financial security, and giving false proof of that security, remain excluded. Other listed exclusions also remain.
Beginning May 7, 2025, convictions requiring sex, kidnap, or child abuse offender registration when applying cannot receive an expungement certificate. An active civil or criminal protective order, or criminal stalking injunction, also blocks a certificate. Specified DUI cases under law codified before February 2, 2005, cannot use automatic expungement, including convictions and pleas held in abeyance. A regular or special certificate must be valid when the petition is filed for the court to use it. Utah’s Bureau of Criminal Identification can challenge orders covering convictions or cases dismissed after pleas held in abeyance; courts must cancel orders they find were ineligible when issued.
Beginning May 7, 2025, courts deciding civil protective orders can consider underlying facts even when related records are expunged. These include facts about the respondent’s arrest, investigation, detention, charges, or conviction. This helps people seeking protection present relevant facts, but limits what record sealing shields in these proceedings.
