New disability coverage with shared costs

Effective May 7, 2025, the law creates Utah’s framework for extra health services for people with disabilities. Utah’s health department must seek federal Medicaid approval before July 1, 2025. Services require federal approval of a waiver or state plan amendment and available state funding; this law provides no funding. The program covers Medicaid services missing from a participant’s other qualifying health insurance, with 12 months of continuous enrollment. Participants must meet the federal disability definition, have had Utah Medicaid within the past 12 months, and have non-Medicaid minimum essential coverage. Household income must be 250%–800% of the federal poverty level. Net assets must be under $125,000, excluding one primary home and one car. Participants must pay income-based costs, with income groups, payment percentages, and monthly caps set by department rules. Above 400% of the poverty level, the required share is at least 10%, capped at $1,500 per month. At or below 400%, department rules set both the percentage and monthly cap. Premiums paid for other qualifying health coverage count toward the required wraparound payment.
