Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Utah can fund odor-control equipment

Beginning May 7, 2025, Utah's Department of Agriculture and Food can use the Qualified Patient Enterprise Fund for equipment. This authority covers a one-time purchase to meet the law's cannabis odor-control requirements. The law sets no purchase amount and does not require payments to producers or households.

Cannabis sites lose special land-use protection

Beginning May 7, 2025, the law removes a special protection against enforcing later land-use rules on cannabis production sites. That protection covered rules adopted after a site submitted a complete application. Cities and counties must follow the state's municipal and county land-use laws when reviewing these applications. Removing the special protection can affect project plans and compliance costs.

Cannabis producers face new odor rules

Beginning May 7, 2025, cannabis production sites in industrial zones must submit odor plans when applying for or renewing licenses. Plans must follow local nuisance rules and identify odor sources, control measures, and equipment maintenance needs. All cannabis production sites must provide odor-emission information when the Utah Department of Agriculture and Food requests it. These duties add compliance work for businesses and require steps aimed at protecting neighbors from nuisance odors.
