Carbon storage violations bring fines

Beginning May 7, 2025, knowing or willful carbon storage violations are Class B misdemeanors. These include false statements, missing required information, destroyed or falsified records, and violations of permits, rules, or orders. Individuals and entities are covered, including entity officers and agents. Each conviction carries a $5,000 fine per violation; each continuing day counts separately. Utah's Board or Division of Oil, Gas, and Mining can also impose administrative penalties or start civil actions within two years after discovering violations. Written notices must identify the alleged violation and facts, and require correction within 45 days after receipt. Continued violations after that period can lead to a lawsuit seeking a court order to stop them. The director can issue an emergency order when a violation immediately threatens public health or welfare.

Utah sets carbon storage oversight rules

Beginning May 7, 2025, the law confirms Utah's Board and Division of Oil, Gas, and Mining can enforce carbon storage rules. The board must adopt penalty rules consistent with the law. Once the Environmental Protection Agency approves Utah's application for primary enforcement authority, Utah gains exclusive state jurisdiction over Class VI wells on nonfederal land. It shares jurisdiction on federal land and can update procedures needed to keep that authority. The board must set fees covering permits, construction, operation, pre-closure work, monitoring and management after closure, and enforcement fund administration. The law also allows additional fees and requires a separate fee under existing carbon storage law; no dollar amounts are specified.
