Beginning May 7, 2025, unauthorized use of a name in charity requests is an infraction, not a class B misdemeanor. Utah also repeals the flag-abuse crime in Section 76-9-601, ending criminal liability under that offense. A related rule makes violations of Subsection (2) of Sections 76-12-402 and 76-12-403 infractions beginning the same date. That rule applies only if H.B. 21 also became law.
Executive-branch agencies, except the attorney general, must review covered criminal offenses by July 1, 2026, and every three years thereafter. Reviews cover offenses agencies prosecute, refer for prosecution, or oversee in their assigned code areas. Agencies must recommend changes, clarifications, or repeal and whether penalties should rise, fall, or stay unchanged. Findings and reasons go to the State Commission on Criminal and Juvenile Justice within 30 days after each review. The licensing division is exempt for offenses in Title 58, Chapters 37–37e. By October 1 each year, the commission must report current-year review data and name noncompliant agencies to the legislative criminal-justice committee.
