Bill Overview

Analyzed Economic Effects

7 provisions identified: 4 benefits, 0 costs, 3 mixed.

Corrections must assess qualifying sex offenders

Utah's Department of Corrections must use a multi-domain risk assessment to guide treatment and supervision for qualifying sex offenders. This applies to convictions after May 7, 2025, for offenses committed in Utah listed in Section 77-41-102(19)(a). The requirement applies only when an assessment validated for the person's population and offense type is available.

Police must report firearm case data

Beginning July 1, 2027, covered Utah law enforcement agencies must report the previous calendar year's firearm data by April 30. Reports must count offenses involving lost, stolen, or untraceable firearms by offense type. They must also count firearms returned, destroyed, retained, transferred, or sold from agency custody. The Department of Corrections and agencies created under Section 41-3-104 are excluded; firearm offenses or investigations under the Wildlife Resources Act are excluded from offense counts. The state criminal justice commission must standardize submissions and publish an annual report by August 1.

Police must report impaired-driving crash data

Beginning May 7, 2025, Utah's public safety department must collect statewide data on crashes that appear linked to impaired driving. Requested data include injuries, deaths, property damage, and impairment test results. Agencies must provide requested information in the department's required format. Beginning January 1, 2026, each law enforcement agency must collect and submit the crash data. The state criminal justice commission includes the data in its annual impaired-driving report.

Police must share records statewide

Beginning July 1, 2025, Utah law enforcement agencies must share records-system information with the state's criminal intelligence system. Agencies must work with the Department of Public Safety on any needed memorandum of understanding or related agreement.

Jails and officers expand biometric collection

Beginning May 7, 2025, Utah county jails must collect required biometric and personal information from everyone processed or booked. This includes people who are not kept in custody. When possible, jails must link each person and their jail records to a state identification number. Beginning January 1, 2027, agencies must supply portable biometric devices to every officer on duty outside the agency's facility.

Justice software vendors must connect systems

Beginning May 7, 2025, qualifying software vendors must build automated connections to Utah's Public Safety Portal. This covers software serving Utah criminal justice agencies that collects and stores data legally required for commission reporting. Connections must work within one year after the agency's system using the software becomes active. The connections support required data reporting but add technical compliance duties for vendors.

State grants face limits and exceptions

Beginning July 1, 2025, Utah's criminal justice commission cannot award state grants to covered entities it has found currently ineligible. This restriction covers entities subject to Sections 53-21-102 and 53-21-104.3. Effective May 7, 2025, the law allows grants under Section 63A-16-1003 despite specified reporting failures. Failure to meet firearm-data reporting requirements does not trigger the general grant restriction. These rules govern agency grants, not household benefit eligibility.
