Beginning May 7, 2025, Utah courts may reduce unpaid criminal debt by the cost of court-ordered treatment or courses. Defendants must finish the court’s requirements and provide proof of completion and payment. The court must find that paying the debt creates serious hardship for the defendant or their family. Defendants must file any petition before their sentence ends. For infractions and class B or C misdemeanors, courts must also consider unpaid service instead of paying fines. Timely completed service earns $10 per hour toward the fine or bail amount, with reasonable time allowed for completion. Eligible work serves a state or local agency, a qualifying nonprofit, or another entity approved beforehand by the court. Defendants must report hours, work details, contact information, and an authorized signature on the organization’s letterhead; courts may require forms. Courts may reject work done before sentencing, claimed in another court, or involving a prohibited organization or service.
Beginning May 7, 2025, Utah courts cannot forgive or reduce restitution principal or interest under this debt-relief rule. Restitution is money owed to victims. Defendants remain responsible for both the original amount and its interest. Unpaid service also cannot replace victim restitution.
