Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Special job classifications for correctional health workers

Utah's human resources director may create a special job classification plan for employees providing inmate health care and clinical treatment. The director must consult state health and corrections officials. Any plan may recognize correctional care challenges but must follow equal-pay and similar-duty rules. The law does not require a plan or guarantee a pay increase.

Psychiatric staffing and support for inmate care

Utah health officials must contract for telehealth psychiatric advice for staff caring for inmates. They must also contract with psychiatrists to fill all correctional psychiatric positions. A 24-month contracting exemption applies after internal staff fill every position for six continuous months. The department must first certify that staffing record to the Health and Human Services Interim Committee.

Treatment planning and court-ordered care for offenders

Beginning May 7, 2025, Utah corrections and health agencies must coordinate mental health assessments, transition plans, and services for qualifying habitual offenders. They must have a mental illness, a high assessed risk of reoffending, and risks that available community services can address. Coordination occurs when clinically appropriate or at least three months before parole ends or the sentence expires. Local mental health authorities must cooperate and include services for this group in their annual plans. Based on their findings, they must take appropriate steps toward civil commitment, court-ordered outpatient treatment, intensive team-based care, or other available community services.
