Utah’s Administrative Procedures Act now covers emergency medical services violation notices and orders. People or groups already authorized by law to challenge these actions can use that review process. The law does not expand who has the right to challenge them.
Utah’s emergency medical services bureau administers and enforces program rules and can fine providers or restrict their licenses or designations. Grounds include rule violations, missed service duties, late renewals, unsafe operations, and gross negligence. Each year, the advisory committee recommends fine ranges by June 1. The bureau publishes a schedule by August 31 for the year starting September 1, considering aggravating or mitigating circumstances when choosing fines. Collected fines go into the Critical Needs Account; the law sets no specific fine amounts.
Beginning May 7, 2025, Utah has an Emergency Medical Services Critical Needs Account funded by state appropriations, interest, and fines. The account and money appropriated from it remain available beyond their usual expiration dates. Year-end grant money left after specified grants goes into this account instead of per-person block grants. The bureau can allocate up to 25% of the account balance each quarter, measured January 1, April 1, July 1, and October 1. Allocations fund grants during the next three months, with provider eligibility and award procedures set by administrative rules.
