Raw milk producers face fines and suspensions

Beginning May 7, 2025, Utah can fine raw milk producers whose products are linked to outbreaks and who violated the law. Maximum fines are $300 for a first violation, $750 for a second, and $1,500 for a third or later violation. Fines can apply alongside a sales-stop order or permit suspension. Utah may restore a suspended permit only after a sample meets bacterial and coliform standards and the producer follows the law and rules. Those standards limit bacterial counts to 20,000 colony-forming units per milliliter and coliform counts to 10. Upon written request, the department must explain how a suspended producer can request a hearing.

Outbreak-linked raw milk sales must stop

Beginning May 7, 2025, Utah must stop a raw milk product's sales when investigation evidence links it to an outbreak. The producer must stop sales, notify buyers of the affected batch, and cooperate with sampling. The agriculture department must collect a sample within two working days of the order or a qualifying producer request. Sales remain stopped until the department verifies compliance and three straight tests meet bacterial and coliform limits without the listed germs. Alternatively, genetic testing can show the product was not linked to the outbreak. The department must notify the producer within one working day after the order ends. Producers can request two labs, but must pay for the second and choose it from the department's approved list. When the department names a producer or uses genetic linkage, it must report sequencing results within 15 working days of sampling. Extra time requires written justification. Before publicly naming the producer, the department must notify them of positive sequencing results linking them to the outbreak.

Raw milk producers face added testing

Beginning May 7, 2025, Utah requires extra testing of raw milk used to make raw milk products. Testing applies when bacterial counts exceed 40,000 colony-forming units per milliliter, coliform counts exceed 20, or an outbreak implicates the producer. The tests check for Shiga toxin-producing E. coli, Listeria monocytogenes, Salmonella, and Campylobacter; the product cannot contain these germs. An outbreak means at least two similar illness cases in different households from a common food. Rules for sales at producer-owned stores must also address third-party testing labs inside or outside Utah.
